Sheltons of Peterborough Limited is a company registered in England and Wales with Company Number 2678186.

In these terms and conditions all references to Sheltons, we, us, our and ourselves shall refer to Sheltons of Peterborough Limited trading company and all references to you or your shall refer to you as the Customer.

1. Mail Order - Aug 2019 Onwards

As of August 2019 the way we take Mail Order payments has changed.

We will now be using PayPal Gateway Services to take Mail Order Payments (No PayPal Account Required).
We can no longer accept any Bank Transfers or Card Payments directly over the Phone (Known as MOTO), as this is now considered very unsecure since the terminals accept very little information in order to verify the card holder at the other end of the phone. Also, as the card holder is not present in store, we have no recourse if the card is reported stolen later on.

How will Mail Order now work?
1.We will take the usual Name, Address, telphone & email address.
2. This will be put into our PayPal account to create an Invoice.
3. You will now recieve an email from our account on PayPal with a link to the Invoice.
2. Once you have clicked the link to the Invoice, you will be able to click on the 'Pay £##' button (Near top left of the Invoice).
3. Then you can select either to Login to your PayPal account and make payment or Pay via Debit or Credit Card (Guest) option near the bottom of the window in order to pay the Invoice.

Once payment has been received your goods will be dispatched.

Why are we changing our methods:
This is due to a recent increase in hacked accounts & Stolen Cards, and because of this our Banks and Card Merchants are insisting on us taking payments through a secure gateway. This is a new procedure for us and one we must take due to losses we have recently incurred.

Therefore we have chosen PayPal as our secure gateway for Mail Orders. Please be assured you do not have to have a PayPal account to pay through PayPal.

2. Availability of Goods<a name="q2"> </a>

Your order for goods is accepted and a contract is formed between Sheltons of Peterborough Ltd (Sheltons Fishing) and you when we despatch the goods you have ordered and not before. A contract is not formed at the point in time that payment has been taken from you by Sheltons of Peterborough Ltd (Sheltons Fishing), nor at the point in time that you receive an email from Sheltons of Peterborough Ltd (Sheltons Fishing) acknowledging receipt of your order. Until the goods are despatched the order may not be accepted by Sheltons of Peterborough Ltd (Sheltons Fishing) or may be cancelled by you.

For security reasons we may restrict the volumes of certain items to be sold in any one transaction.

Advanced Orders. Where items on the website are offered on an Advanced/ Pre-Order basis, all effort is made to give an acurate time of availability based on that given by our supplier/ manufacturer. If this time is unable to met by Sheltons of Peterborough Ltd (Sheltons Fishing) beyond our reasonable control Sheltons of Peterborough Ltd (Sheltons Fishing) reserves the right to cancel all orders and issue a full refund.

Following formation of the contract Sheltons of Peterborough Ltd (Sheltons Fishing) shall continue to own any goods ordered until it has received payment in full from you even though the goods may have already been delivered to you.

3. Prices <a name="q3"> </a>

Published prices are liable to alteration without notice. All orders accepted by us are subject to VAT at the prevailing rate. VAT at 20% is included in the recommended retail prices shown on the web site and in any price list currently published by us.

4. Delivery & Shipping

Delivery will be made by our appointed Carriers or by Royal Mail to the address of the Card Holder. If you wish to have your Order Delivered to your Work Address you will need to call the Shop on 01733 865870 before placing an Order.

Every effort will be made to execute your Order swiftly and efficiently. Back-orders will only be held on request.

Shipping is to the UK Mainland only.

All deliveries are calculated on a Volumetric charge. The charge for delivery will be calculated and displayed during the checkout process. If you feel the price for your delivery is high please contact us on 01733 865870.

All Deliveries are on a 4-5 Days unless they are advanced orders, which will be shipped as soon as we receive them in store.

If you wish to have your items Delivered to Northern or Republic of Ireland then we will be happy to provide a quote as long as the Delivery Address is the same as the Card Holders Address. Please request a Quote before placing an Order by calling 01733 865870.

Reserve & Collect
When placing a Reserve and Collect Order, please wait until you have received a Confirmation email stating that your order is ready to collect before arriving at the shop.

5. Weights & Measures

All sizes, weights and measurements are approximate, but Sheltons aim is to be as accurate as possible.

6. Damaged and Unsuitable Goods

We recognise that you have a right to cancel your Order with us, in accordance with the Consumer Protection (Distance Selling) Regulations 2000 ("the Regulations"). The period allowed by law to exercise that right is 7 working days. Please refer to Notice of Cancellation for details of how you cancel your order.

Goods must be returned at the Customer's expense as soon as possible, unused and in the original undamaged packaging and we reserve the right to have the goods inspected by a technician prior to replacement or refund of the goods. Goods are returned to us at the Customer's risk.

In the unlikely event that your Order is visibly damaged on delivery, please refuse acceptance of the delivery if possible. Otherwise, please contact us immediately on 01733 865870 to be issued with a Query Reference Number. We shall have no liability to you unless you notify us within 5 working days of the delivery of your Order.

We regret that only the provision of a valid Query Reference Number constitutes notice to Sheltons of Peterborough.

7. Notice of Cancellation

Sheltons of Peterborough Ltd (Sheltons Fishing) reserve the right to cancel the order if we are unable to accept your order. If this is the case we will inform you of this and will re-emburse the card used for paymentt. This might be because the product is out of stock and are not ably to get supply within a reasonable amount of time, we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline.

To cancel your Order under the Regulations you must notify us in writing by Email or by writing to us (see Contact Details above) within 7 working days (this does not include Saturdays, Sundays or public holidays) commencing the day after the day of delivery of your Order, quoting your Order Number. You must take reasonable care of the goods.

Once you have notified us that you are cancelling your Order, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

8. Returning Goods to Us

When goods are returned to us they must be in 'as new' condition, in full packs, etc.

Unauthorised goods will not be accepted. Authorisation of returns must be requested, along with the issue of a valid Query Reference Number prior to the return of goods.

If goods are to be returned, you will be advised of the best method of return upon issue of a Query Reference Number. We advise the enclosing of proof of purchase along with your full personal details.

If returning goods using standard Post, we advise you obtain a certificate of posting from your Post Office or courier. Regretfully we cannot be held responsible for goods whilst in transit.

In all cases, where letters and/or parcels are sent via the Post Office or any other agency, the Post Office or said agency act for the sender and any late or non-delivery is the responsibility of the sender.

9. Rewarehousing & Administration Charges

No charge will be applied for goods returned to us in accordance with the Regulations. For all other goods returned, where the provisions of the Regulations do not apply, we reserve the right to add a re-stocking charge of 15% of the price of the goods returned to us, at our discretion.

10. Liability

The liability of Sheltons of Peterborough to the Customer in respect of defective goods, damaged goods or goods delivered that are not what you ordered, shall be limited to replacement of the goods in question or refund of the price paid by the Customer provided that the Customer notifies us in writing of the defect or damage within 5 working days of the delivery of the goods in question.

If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods.

If you notify a problem to us under this condition, our only obligation will be, at your option:

(a). to make good any shortage or non-delivery, or
(b). to replace or repair any goods that are damaged or defective, or
(c). to refund to you the amount paid by you for the goods in question in whatever way we choose.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under (c). above.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you may have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

11. Cheques <a name="q11"> </a>

We no longer accept cheques as a form of payment instore or mailorder.

12. General Terms <a name="q12"></a>

Governing Law
These terms and conditions shall be construed in accordance with English Law and shall be subject to the non exclusion jurisdiction of the English Courts and Shelton's of Peterborough Limited agrees to supply and you (the Customer) agrees to purchase goods subject to these terms and conditions.

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and all notices from us to you will be displayed on our website from time to time.

Events beyond our control
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

If any part of these terms and conditions is unenforceable (incuding any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

Third Party Rights
Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Entire Agreement
These terms and conditions, together with our curent website prices, delivery details and contact details, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

These Terms and Conditions supersede and take precedence over any previously published Terms and Conditions. All goods remain the property of Sheltons of Peterborough Limited until full payment has been received.
